Safety and Security:
Electronic monitoring devices should never be relied upon as anyone's primary source of safety and security. They should be used ONLY as one of several back-up measures to other redundant safety protocols put into place by the various parties legally responsible for the care and/or conduct of the monitored person. NO electronic monitoring/tracking device is completely fail-safe, nor can they be expected to be effective 100% of the time.
No Law Enforcement Powers:
Sunset Monitoring Services is a private provider of electronic monitoring services. We are a privately owned company operated by private individuals. As such, we do not have ANY law enforcement authority nor do we have any other special law enforcement powers, nor any civil authority to enforce any law, statute, ordinance or any order of the court.
What Electronic Monitoring Services Can and Cannot Do:
Sunset Monitoring Services' electronic monitoring services/products cannot prevent a monitored person from intentionally violating any home detention requirements of any nature, nor can we prevent a monitored person from committing any new crime(s) while they are being monitored by us. We can only report to the referring agency within a reasonable amount of time and within a reasonable level of accuracy that the monitored person either is or is not where they are supposed to be, when they are supposed to be there. Depending on the particular equipment being used at the time, we may also be able to report, within a reasonable level of accuracy and dependability, that the person being monitored either has or has not recently consumed alcohol. Also, depending on the particular equipment being used, and various other circumstances, we MAY or may not be able to report a monitored person's exact location at any given time. It is the responsibility of the referring agency and/or of the court to take appropriate legal action in response to any violations of the law or violations of court orders committed by monitored individuals.
Equipment Design and Subsequent Services Limitations:
Our products and services are NOT designed nor intended to deter or prevent kidnappings, abductions, or runaways nor can they be expected to prevent any person from becoming missing, nor can our products/services guarantee the safe return of any monitored person in any particular circumstance. Product quality, reliability, accuracy and effectiveness may be influenced and/or inhibited temporarily or permanently by numerous differing environmental and/or physical conditions in any area where our services are being used at any given time.
No Warranty of Successful Outcome:
Sunset Monitoring Services does not make any representation or warranty of any kind that our products or services will be successful in deterring absconsion, alcohol consumption or any other non-compliance what-so-ever of any monitored defendant/offender or other monitored individual. Sunset Monitoring Services makes no guarantee of success in locating/returning or determining the whereabouts any monitored person, at any time, even under the most ideal of circumstances. We can only promise to put forth our very best efforts to provide the particular monitoring service(s) originally agreed upon and to do our best to help locate a monitored person, within the particular limitations of our equipment under the given circumstances at the time, should the need arise.

At Sunset Monitoring Services our top priority is our client’s complete satisfaction delivered with unyielding honesty and integrity. We strive at all times, to achieve 100% quality service in every business transaction we conduct. If for some reason, any of our customers ever feels their particular service and/or product requirements have not been met, or they feel they did not receive exactly the service and/or product we promised, we will work diligently with that customer to find a mutually satisfactory and reasonable solution to the problem if and whenever possible. This may include, at the sole discretion of Sunset Monitoring Services; a modification of future services/products provided, a partial or full refund of a payment or payments received, or any other solution or solutions Sunset Monitoring Services may deem appropriate to the particular circumstances, on a case by case basis. In every circumstance, Sunset Monitoring Services will make every viable effort we believe we reasonably can, to find the best, most appropriate and when possible, mutually satisfactory resolution to each matter in question.
Fraud/Suspected Fraud
General Precautions:
At Sunset Monitoring Services, we have in place, several layers of stringent policies, procedures and processes, specifically designed to guard against and to aid in the prevention of fraud. Of course, no matter how good our systems and procedures are, there is no possible way to guard against all incidents of fraud. We admonish all of our customers that the best way to guard against possible occurrences of fraud, is for all individuals to accept their personal responsibility for protecting all of their private and sensitive personal information from anyone and everyone, including close family members, relatives and friends who could potentially misuse that information, no matter how unlikely one may believe such potential misuse may be.

If you have enrolled in Sunset Monitoring Services’ “Invoice by e-mail” program, you will be contacted promptly by the same Sunset Monitoring Services account executive, responsible for your ongoing service. They alone, will provide you with the proper security protocols for you to be certain any e-mail invoices you receive, are in fact, the genuine article. For security reasons, this initial “Invoice by e-mail” security protocol contact will not take place by e-mail and will take place before we ever send you any actual invoices by/through e-mail. If you are contacted by anyone other than your usual account executive, do not provide them with any information and please contact Sunset Monitoring Services immediately. If you ever have any questions or doubt of any kind, what so ever, about a communication received from Sunset Monitoring Services please call us at, 888-944-1082 or call your usual account executive, before proceeding.
Liability Admonition:
In certain circumstances, failure on the part of an alleged fraud victim to have exercised reasonable care and/or caution to protect their personal information or to properly and promptly report the misuse thereof, may limit the ability of said victim to pursue some of the financial recovery remedies otherwise provided under the law. This may also limit the liability of third parties, such as Sunset Monitoring Services, having in good faith, accepted such information in regard to payment for goods and/or services provided. Furthermore, under certain circumstances the alleged victim may be held accountable by the courts, civilly and/or criminally as an accomplice or accessory to the fraud. In light of this, Sunset Monitoring Services strongly encourages our customers to exercise all possible care and diligence to safeguard any and all sensitive personal information at all times.
Handling Fraud/Suspected Fraud:
In the unlikely event of fraud or suspected fraud, Sunset Monitoring Services will work diligently with you, your local law enforcement agency/agencies and any other appropriate investigative body, to determine if, in fact, an actual incident of fraud has occurred. Wherever appropriate, we will use any and all means at the disposal of Sunset Monitoring Services, to pursue aggressive and complete legal prosecution of the perpetrator(s) to the fullest extent allowable under the law.
Assistance Required:
Sunset Monitoring Services requires, whenever necessary, reasonably appropriate and when allowed by law, the complete cooperation and full participation of any alleged fraud victim(s), to the fullest extent they are able, to assist in, any/all reasonable and appropriate investigative efforts to ascertain the identity and location of, any/all alleged perpetrators of a fraud. Sunset Monitoring Services also requires, when necessary, reasonably appropriate and allowed by law, the complete cooperation and participation of any alleged fraud victim(s), to the fullest extent to which, they are capable, to aid in the pursuit of, aggressive and complete legal prosecution(s) of the alleged perpetrator(s) of the alleged fraud, to the fullest extent allowable by law.
Recompense:
Subject to the terms and conditions above and/or any stipulations and/or limitations set-forth in criminal and/or civil law, Sunset Monitoring Services/ sunsetmonitoring.com will work diligently, under all circumstances, which are reasonable, appropriate and legal, to secure a prompt and full refund and/or wherever appropriate and legally permissible, Sunset Monitoring Services will assist to the best of our abilities, with the pursuit of restitution and/or punitive damages sought by any actual victim of a promptly, accurately and properly reported, fraudulent payment or payments made to, or received by, Sunset Monitoring Services.
To report an incident of fraud:
Please contact your local police department, sheriff’s office or other properly required law enforcement agency as soon as possible and make any appropriately necessary criminal offense report. Be sure to obtain an incident report number or case number. Once you have an incident report number or case number, please call Sunset Monitoring Services as soon as possible at, 888-944-1082. When you call, please be prepared to provide to Sunset Monitoring Services, your full name, the law enforcement agencies’ incident report number or case number, the date(s) of the alleged fraud, the full amount of the alleged fraud, the full names of any suspected perpetrators and any other relevant details you may have. At your discretion, you may choose to notify Sunset Monitoring Services by promptly submitting these same details to us in writing. Overpayment for Services:
By the very nature of Sunset Monitoring Services’ business model, which is primarily a pre-paid arrangement for services to be delivered, there will inevitably be circumstances, where services may be paid for, then for whatever reason, will not actually be rendered. Whenever a paid service contract is terminated early, per the terms of the said service contract, whether the termination is made by the referring agency, Sunset Monitoring Services and/or it’s agents, or by our client; a prompt evaluation will be conducted by Sunset Monitoring Services to determine what, if any refund may be due. Any refunds shall be contingent upon all of Sunset Monitoring Services’ equipment, which we may have assigned to the client, being promptly returned to Sunset Monitoring Services entirely undamaged, in a timely manor (generally within 72 hours or less following the end of monitoring). Sunset Monitoring Services will, endeavor to make any properly owed, refund(s) within a reasonable period of time, which ordinarily should not to exceed a period of sixty (60) days, for any services paid for in advance, but not received.
Upon receipt of a properly tendered, written notice concerning the termination of service, given to, or by Sunset Monitoring Services at least seven (7) full days in advance of said termination, a full refund may be made, for any services paid for in advance, but not received, so long as no other monies are owed by the client, to Sunset Monitoring Services for any other reason(s) and subject to any and all additional terms of this and/or any associated service contracts/agreements between Sunset Monitoring Services and the client.
If for any reason, Sunset Monitoring Services is/was NOT provided written notice concerning the termination of our services at least seven (7) full days advance of said termination, or unless other prior written arrangements were made to the contrary, pre-paid service fee refunds shall not, in any case, exceed two-thirds (2/3) of the ordinary daily monitoring fee for the first seven (7) days or less, of any pre-paid amount for accounts otherwise in good standing. This stipulation applies regardless of whether or not the client knew or could have known about the early termination, and/or whether or not the client and/or Sunset Monitoring Services had any control or influence what-so-ever over the early termination. Any pre-paid service fees extending beyond the period of seven (7) days, may be refunded in full, so long as no other monies are owed by the client, to Sunset Monitoring Services for any other reason(s) and subject to any and all additional terms of this and/or any associated service contracts/agreements between Sunset Monitoring Services and the client.
Over payments during an on-going service contract cycle, will be applied to up-coming/future service periods. At the end of that client’s naturally expiring service contract, wherein by the nature of the natural expiration of the service contract, Sunset Monitoring Services had been provided at least seven (7) full days advanced notice of the termination of services, any excess monies, which may have been received by Sunset Monitoring Services, which still remain on account, may be refunded in full so long as no other monies are owed, by the client to Sunset Monitoring Services for any other reason(s) and subject to any and all additional terms of this and/or any associated service contracts/agreements between Sunset Monitoring Services and the client.
Refunds shall not, in any case, exceed the ordinary daily monitoring service fees pre-paid and shall not in any case include any handling fees, late fees, interest charges or special maintenance fees of any kind. Sunset Monitoring Services will not refund any re-activation fee(s) paid on accounts previously terminated for non-payment, but subsequently re-activated regardless of how long the re-activated monitoring period lasts. Please refer to your service contract for additional details and/or limitations regarding this policy. Special Handling Fees, Late Fees, Penalties and Interest Charges:
Unless other prior written agreements are made, all payments made electronically, telephonically or which necessitate an in person visit by a Sunset Monitoring Services Representative, will be subject to various handling charges, which shall be disclosed no later than the time the payment is being made. These handling charges shall ordinarily be of an amount under $10.00, they however may exceed that amount under certain circumstances. Payments made in cash during an otherwise scheduled appointment and payments made by cashier's check, official bank check or money order, which is/are received on-time to be posted to a client's account, prior to the due date, will NOT be subject to handling charges. Personal checks are NOT ordinarily considered an acceptable form of payment to Sunset Monitoring Services. If a personal check is taken on an exception basis, said payment will be subject to a special handling fee as a condition of its acceptance. Personal checks returned for non-sufficient funds or any payments returned for any other reason, by the client's financial institution will result in the client being assessed a $30.00 returned check/returned payment fee and the client may be additionally subjected to possible late fees, interest charges and the possible termination of services. Depending on the timing involved, this could also result in the assessment of a service re-instatement fee and additional handling charges as well.
Past due accounts will be assessed a late fee at 12:01 a.m. MST on the 6th day following the earliest due date for any amount then owed on the account. Unless other prior written arrangements have been made, additional late fees will be assessed at 12:01 a.m. MST on the 6th day of each month thereafter, until the account is current and all payments are resolved as fully collected funds. Any late fees assessed, shall be the greater of, 5% of the unpaid balance or $20.00 with the minimum late fee being $20.00. Additional interest charges will be assessed to past due accounts beginning as of the 1st day of the month, in which the account reaches the 31st day past due, regardless of what day of that month the 31st day after the account became past due actually occurs. If the amount due is fully collected prior to the account reaching the 31st day past due, NO interest will be assessed. If interest is charged, it will be assessed at a daily compounding rate of, 0.08219178% (approximately 35% APR depending upon the actual balances). Extended payment plans may be accepted on a case by case basis regarding past due accounts. If such arrangements are entered into, subsequent late fees shall thereafter and henceforth, attach at 12:01 a.m. MST on the 6th day after any scheduled payment becomes past due. Unless other prior written arrangements have been made, Sunset Monitoring Services shall adversely terminate past due payment plan accounts at 11:59 p.m. MST on the 14th day after any scheduled payment becomes past due.
Sunset Monitoring Services will NOT provide a letter of successful program completion for clients who have failed to abide by the financial agreement, until all the terms and conditions of the financial agreement are fully satisfied.
Sunset Monitoring Services reserves the right at any time, regarding the failure to pay for services rendered, to refer these matters to the appropriate criminal court(s) and to prefer misdemeanor and/or felony theft charges under Utah State Statute: 76-6-409 UCA and/or any other appropriate Federal, State, and/or local law, statute and/or ordinance. This could result in additional fines, penalties, restitution and/or any other sanction(s)available to the criminal court. Sunset Monitoring Services, also reserves the right to separately seek civil remedies regarding clients who fail to abide by the financial agreement. Among these remedies, Sunset Monitoring Services reserves the right to assign the client’s debt to a third party for collection. When a debt is so assigned, an additional collection fee of 40% will be assessed over an above the amount which was owed to Sunset Monitoring Services at the time the matter is referred for collection. Sunset Monitoring Services and/or our agent and/or representative(s) may also seek civil judgment(s) for not only the principal originally owed, but for all interest, late fees, collection fees and penalties assessed, as well as all additional collectioncosts, fees and expenses including, but not limited to; the 40% collection fee, reasonable attorney's fees, court costs, constable fees, private investigator’s fees and all additional fees and/or expenses of any description associated with collection of the debt owed. Civil judgments could result in the attachment of any current and/or future assets legally in the possession of the debtor, as well as wage garnishments and/or tax liens and an adverse credit report being filed.
